“User” refers to any individual or entity accessing or using the Platform.
“Employer” refers to any user posting job listings on the Platform.
“Candidate” refers to any user submitting applications through the Platform.
User Accounts
- Users must create an account to access certain features of the Platform.
- Users are responsible for maintaining the confidentiality of their account credentials.
- The Platform reserves the right to suspend or terminate accounts for any violation of these terms.
User Conduct
- Users must not engage in any unlawful, abusive, or harassing behavior on the Platform.
- Users must comply with all applicable laws and regulations.
- The Platform reserves the right to remove any content that violates these terms or take appropriate action, including content removal and account suspension.
Job Listings and Applications
- Employers may post job listings on the Platform.
- Job listings must be accurate, non-discriminatory, and comply with all applicable laws.
- Candidates may submit applications through the Platform.
- Employers are responsible for managing applications and communicating with candidates.
Candidate Profiles
- Candidates may create profiles on the Platform.
- Profiles must be accurate and up-to-date.
- The Platform may use candidate information in accordance with its Privacy Policy.
Privacy and Data Protection
- The Platform collects and uses personal data in accordance with its Privacy Policy.
- By using the Platform, users consent to the collection and use of their personal data.
Intellectual Property
- Users retain ownership of content they upload to the Platform. By uploading content, Users grant the Platform a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, and display the content for the purposes of operating, promoting, and improving the services.
Fees and Payments
- The Platform may charge fees for certain services.
- Payment terms will be provided at the time of purchase.
- All fees are non-refundable unless otherwise stated.
- If applicable, subscription services will automatically renew unless canceled by the User before the renewal date. Users may cancel subscriptions through their account settings.
Liability and Disclaimers
- The Platform is provided on an “as-is” basis, and use of the Platform is at the User’s own risk. The Platform disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
- The Platform’s liability to Users is limited to the amount paid by the User for the services, and in no event will the Platform be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.
Termination
- The Platform reserves the right to terminate or suspend user accounts at any time.
- Termination may result in the loss of access to certain features or content.
Governing Law and Dispute Resolution
- These terms are governed by the laws of the state of Idaho, without regard to its conflict of law principles.
- Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Boise, Idaho. Users agree to submit to the jurisdiction of such arbitration and waive any objections to such venue.
Force Majeure
- The Platform shall not be liable for any failure or delay in performing its obligations under these terms if such failure or delay is due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, internet failures, or acts of government.
Updates and Modifications
- The Platform may update these terms from time to time. Users will be notified of any changes to these terms, and the updated Terms and Conditions will be effective immediately upon posting. Users are encouraged to review these terms periodically to stay informed of any updates.
Indemnification
- Users agree to indemnify and hold harmless the Platform, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or losses arising out of or related to the User’s use of the Platform, violation of these terms, or infringement of third-party rights.
Miscellaneous
- If any provision of these terms is found to be invalid, the remaining provisions will remain in effect.
- These terms constitute the entire agreement between the parties.
